Action Plan for Improving Business Environment of Lvliang City

In order to thoroughly follow the guidelines of the 4th Plenary Session of the 19th CPC National Congress, further reengineer the governmental functions, improve the government service efficiency, form the business environment characterized by “the least review and approval procedure, the optimal workflow, the most unimpeded system, the most flexible mechanism, the highest efficiency and the best service” at a faster pace, and build Lvliang into a business environment improvement demonstration city in Shanxi Province, make more contributions to enterprise development, stimulate the market vigor and innovation power, this Action Plan is hereby developed in accordance with the national and provincial decisions and arrangements for deepening the reform of "streamlining administration, delegating power, strengthening regulation, improving service, and raising efficiency" to improve the business environment, with full considerations to actual situation of Lvliang City.

I. Work Tasks and Division of Responsibilities

(I) Reform of commercial system

1. To shorten preparation duration for business startup. It will take one and a half working days to complete enterprise registration, official seal engraving, tax receipt application, bank account opening, social security handling and other formalities. Lvliang will actively duplicate the whole process of business startup in an online manner and vigorously promote the application of electronic business licenses. 2. To make progress in the reform of separating operating permits and business licenses: By abolishing approval system, replacing approval with record filing, implementing notification and commitment and improving market access services, Lvliang will push forward the reform of "separating operating permits from business licenses" so that enterprises can use their business licenses as a single key to market access and permit operation in a two-pronged manner. Lvliang will gradually minimize the administrative examination and approval matters for enterprises, and conduct classified management for the administrative examination and approval matters related to market access and business permit according to such a reform mode. 3. To make progress in the reform of “integrating multiple permits in one”: Under the principle of integration, simplification and deletion, on the basis of “integrating five permits in one” for enterprise license and permit matters, it is necessary to launch the dynamic management of the enterprise license and permit matters in the reform of “integrating multiple permits in one”. License and permit matters beyond the catalogue, which comply with integration requirements, will be included in the reform scope of "integrating multiple permits in one" by stages and in batches. It is necessary to strengthen the mutual recognition and use of business licenses through “integrating multiple permits in one and unifying code for one operating permit" among various competent authorities, and accelerate the reform of integrating the 30 permits in one”. 4. To deepen the reform of simple enterprise deregistration: It is necessary to expand the scope of simple enterprise deregistration and shorten the duration for simple enterprise deregistration announcement. The duration for simple enterprise deregistration announcement should be further shortened, while deregistration processes should be simplified and optimized. Those non-listed limited stock companies, subsidiaries of limited liability companies and other types of enterprises should be eligible for simple enterprise deregistration. As for such enterprises that are not in arrears with social insurance expenditures and have no employee insurance coverage, social security authorities should give timely feedback opinion on "deregistration without objection", and synchronously cancel social insurance registration. It is necessary to strengthen simple business deregistration synergy between market supervision authorities and tax authorities. Enterprise tax clearance prompts should be posted before the announcement about simple enterprise deregistration. As for the enterprises that have not completed the tax-related matters, the tax authorities should raise objections on the following day after the expiry of the announcement period. 5. To accelerate the transformation of industrial product production license to product certification. It is necessary to comprehensively review production permits for industrial products, and further reduce the products subject to license management to about 15 categories by the end of 2019. It is necessary to make more efforts for publicity of relevant policies of China’s compulsory product certification (CCC), coordinate and solve the knotty problems of post-certification supervision. (II) Real estate registration

6. To make progress in reform of real estate registration: It is necessary to fully implement "one window acceptance and integrated services" for housing transactions, real estate registration and tax collection, further shortening the processing time for real estate registration; by the end of 2019, the immediate handling of real estate attachment will be achieved, and it will take three working days to complete mortgage and cancellation of the registration; by 2020, other real estate registration will be shortened within five working days. 7. To improve the information infrastructure of real estate registration: It is necessary to complete the transfer of information on the registration of housing stock, improve the information database on land cadastres, and introduce unified measures to solve the remaining problems related to real estate, so as to further consolidate the information infrastructure of real estate registration; strengthen the integration of stock data, improve the quality of information sharing, complete the integration, acceptance and submitting of real estate stock data, and establish a sound real estate registration database. 8. To set up pilot projects for the ownership transfer (opening an account) of water, power, gas and digital TV and the interactive real estate registration: It is necessary to set corresponding service windows at the government service hall, and build an integrated service platform for the transfer of water, power, gas and digital TV on mobile APPs. (III) Reform of project approval

9. To deepen the reform of the investment commitment system for enterprises: It is necessary to formulate lists, access conditions, standards and procedures of the commitment system for investment projects; implement parallel inspection and approval across the board, and unified process of "notification with lists, platform handling, process reengineering, multi-map joint review, and charge management", and speed up project approval in an all-round way; strengthen the supervision and management of services during and after the handling, organize competent authorities to formulate measures for the supervision and management of services, do a good job in the pre-review after commitment, parallel inspection before construction, and acceptance after completion, and strengthen the whole-process technical guidance and policy consulting; promote Xiaoyi Economic Development Zone to carry out the trial commitment system of enterprise investment projects and the pilot work of lifting approval from management. 10. To vigorously promote joint review: It is necessary to promote the reform of comprehensive consultation for investment projects and whole-process consultation for projects, and improve the evaluation prior to integrated approval; improve the six normal mechanisms, i.e. interactive inspection and approval, three-tier linkage across provinces, cities and counties, responsibility of functional authorities, project-based management, coordination and dispatch, supervision and assessment, and ensure the smooth progress of project construction. 11. To explore regional assessment: It is necessary to select key areas for regional assessment, organize the formulation of land reconnaissance and delimitation, geological disaster risk assessment, assessment of mineral resources overlaid by construction projects, seismic safety evaluation, environment impact assessment, energy-saving assessment, review of soil and water conservation scheme, weather feasibility, cultural relics evaluation, land price evaluation, land reclamation and other regional special assessment; besides, the assessment reports will be valid within five years, and are free to share by the projects settled in, so as to reduce the corporate investment cost. Before transferring land, the government will organize intermediary evaluations, and the fees are included in the land transfer fees. In principle, no repeated evaluations on corporate construction projects will be carried out. 12. To holistically push forward the reform of the approval system for construction projects: It is necessary to unify approval process, streamline procedures, improve the approval system, harness project implementation with "one blueprint", carry out unified management with "one system", provide services with "one window", integrate application documents with "one form", and standardize the approval operation with "one mechanism". Lvliang will reduce the approval time of general industrial projects from launch to completion and acceptance to forty-five working days through measures of "streamlining, combination, transformation, adjustment and commitment". With the exception of special projects and major projects in the fields of transport, water conservancy and energy, the time limit for the approval of construction projects from launch to completion and acceptance will be reduced to within one hundred working days. Within five years, the whole-process approval time will be cut by more than half. 13. To encourage social capital to flow into traditional infrastructure and public services: It is necessary to study, formulate and improve the management measures for the cooperation between the municipal government and private capital in the field of infrastructure and public services; establish and improve the effective promoting mechanism of Public-Private Partnership (PPP), and encourage social capital to flow into the traditional infrastructure like energy, transport, water conservancy, environmental protection, agriculture, forestry, and major municipal engineering, as well as public services like municipal utilities, affordable housing, education, science and technology, culture, sports, health care, pension, and tourism, by means of franchising and equity cooperation. Under the same conditions, priority should be given to encouraging private investment and private capital to participate in the construction of projects in Lvliang. 14. To deepen the special action against malicious stoppers and spoilers: It is necessary to launch special campaigns to crack down on crimes and all kinds of illegal and criminal activities that disrupt the normal production and operation of enterprises, strengthen public security in the surrounding areas of enterprises, and create a good public security environment for enterprise operations and project construction. (IV) Government services

15. To standardize matters related to administrative power: It is necessary to focus on matters related to administrative power that are applied in accordance with the law, sort out a standardize catalog, implementation list and handling information, and promote the unification of basic elements such as the name, number, basis and type of the same matter at the national, provincial, municipal and county levels. 16. To organize and standardize public services: It is necessary to holistically sort out public services that are closely related to people’s daily work and life, such as education, medical health, housing, social security, civil affairs, poverty alleviation, and public legal services. Lvliang will speed up the compilation and issuance of lists and guidelines for public services at the municipal and county levels, and will not add any requirements for handling affairs except for the conditions specified in the guidelines. 17. To standardize the handling of government services: It is necessary to refine and quantify the service standards for approval in the spirit of science, standardize the right of discretion, improve applicable rules, and ensure that the same matter is accepted without discrimination and handled in line with the same standards. Lvliang will build and improve flow charts (tables) for handling government services, and promote standardization of related requirements and guidelines. Focusing on key areas and matters of great concern to enterprises and the people and with a considerable amount of need, such as real estate registration, market access, enterprise investment, construction projects, and people’s livelihood, Lvliang will formulate work procedures and guidelines that reduce procedures, documents, time limits and costs, and implement the principle of "one notification and one application form". 18. To improve online processing: It is necessary to rely on the identity authentication, electronic seals and electronic certificates of the provincial integrated e-government service platform, and promote the sharing and mutual recognition of certificates, documents and data resources; further reduce procedures, streamline documents, shorten the processing time limit, speed up the "whole-process online handling" of application, acceptance, review, decision, license production, publicity, charges and consultation. 19. To vigorously push intermediary services reform for administrative review and approval: It is necessary to further reduce intermediary services for administrative examination and approval, and as for the reserved services, the processing time limit, working procedures, application conditions and charging standards should be clearly defined and made public. Lvliang will punish "red top mediation" in accordance with the law, cut off their interest connections, cancel or reduce fees charged by competent authorities for intermediary services and fees charged by industry associations and chambers of commerce; focus on investigating and punishing government authorities for transferring fees to other intermediaries and illegally charging fees for intermediary services for administrative review and approval, and crack down on all types of "grey" and "black" intermediaries in accordance with the law; relax market access for intermediary services and break up monopoly. Relying on the municipal government service network, Lvliang will accelerate the development of an "online platform" for intermediary services, which is open to service intermediaries with "zero threshold or restrictions", achieving display, bidding and evaluation online. 20. To build and connect with the electronic signature management system: It is necessary to improve the online real-name identity authentication system, clarify the legal effect of electronic licenses, electronic official documents and electronic seals, establish and improve basic standards and norms, and realize "collection at once, management with one database that is open to multi-parties at any time". 21. To promote the online handling of government services: It is necessary to improve the handling functions of integrated e-government service platform. Unless otherwise stipulated by laws and regulations or confidential matters, all matters should be incorporated into the platform for handling. Lvliang will expand the breadth and depth of online services, extend the chain of online services, and evolve from online consultation and application to online pre-review, handling and feedback. By the end of 2019, more than 80% of government services at the municipal and county levels should be handled online; by the end of 2020, the e-government service platform should be fully connected with the national and provincial e-government service platforms, and all government services should be fully available; by the end of 2022, the integrated e-government service platform should be improved, and the "access more government services via a single website" will be fully realized. 22. To improve the functions of government service hall: It is necessary to center on the goals of "one site", "one window" and "one-time handling", further improve the centralized service mode of city, county and township comprehensive government halls, and enhance service functions. Lvliang will encourage government services provided by authorities under vertical management to be handled centrally at the comprehensive government hall, improve the window settings, reduce the waiting time of enterprises and the people, and make it less than 15 minutes for people to wait in line for services; smooth access to consultation, complaint, reporting and suggestion, implement the work mode of " comprehensive acceptance at reception, back-stage classified approval, handling at comprehensive windows"; establish and improve the mechanism of multi-department joint offices and explore the introduction of a whole-process assistant system; accelerate the registration of municipal and county government services in comprehensive entity government halls and the acceptance of government services through one window. By the end of 2020, government services at all levels should be duly promoted, and more than 70% of which should be handled through one window. 23. To promote mobile government services: It is necessary to focus on public security, human resources and social security, education, health care, civil affairs, urban and rural housing, actively promote the extension of government services that cover a wide range of areas and are frequently used onto mobile devices, enabling more government services to be handled at mobile terminals. Lvliang will accelerate to upgrade the "Lvliang Government Affairs" APP, expand the functions of government services, increase the handling affairs, set up guidelines for handling, release the latest policies, give full play to the advantages of new media for government affairs, and facilitate enterprises and the people in handling affairs. 24. To extend government services to communities: It is necessary to speed up the construction of convenient service centers at villages and towns (streets) and convenient service sites at communities, promote e-government service platforms and convenient services to the countryside, and set up convenient service agent points at qualified villages; promote the application of e-government services based on Internet, self-service terminals, mobile terminals to the grassroots level in an all-round way, and build "one-stop" comprehensive convenient service platform at the grassroots level; make full use of the shared e-government service resources, and provide convenient policy consultation and handling services to the people, with the focus on providing door-to-door and free government services in such areas as labor and employment, social insurance, social assistance, and poverty alleviation; move faster to extend e-government services to remote and poor areas. In rural areas, where transport is poor, homes are scattered, and with many elderly people left behind, Lvliang will actively provide services such as paying government fees, handling government affairs, and acting as agents for the people; in areas where conditions permit, online service stations will be set up in all villages, so as to improve the rural service system for the people. 25. To secure the government affairs platform and data sharing: It is necessary to study and improve the data security management system and measures, strengthen the security management of government data sharing, and improve the data security assurance of government platforms. Lvliang will give full play to the guarantee function of password application in the sharing and use of database, ensure the security of government network and data information, and protect business secrets and personal privacy. 26. To continue the campaign of "reducing certificates for the convenience of the people": It is necessary to further streamline the sealing, reviewing, recording, confirmation, notification and other procedures; resolutely implement the State Council’s requirement that all six certificates be cancelled, and holistically cancel "strange" certificates, circular certificates and repeated certificates that annoy enterprises and the people; review and standardize all kinds of certificates set by government regulations and normative documents, implement list management for certificates that need to be retained, and promptly publish lists of certificates reserved at the municipal and county levels. Except for the lists, government authorities, public utilities and service intermediaries are not allowed to require certificates. Lvliang will carry out a pilot program of the notification and commitment system for certification items, and severely punish false commitments in accordance with the law. 27. To accelerate the reform of notary services: It is necessary to holistically carry out the reform of "one-time handling", connect between notary offices and the information systems of relevant government authorities, and improve service efficiency. 28. To delegate power to development zones according to law: It is necessary to promote the experience of the provincial government in authorizing Shanxi Comprehensive Reform Demonstration Zone, further promote the authorization and empowerment of development zones (parks) in accordance with the principle of "granting and delegating power as much as possible".

29. To establish the promoting mechanism for investment attraction and contract projects: It is necessary to establish a notification system for investment projects, track and supervise the signed projects; establish a service coordination mechanism for contracted projects, hold joint meetings for promotion, open a "green channel" for the approval of key projects, and provide local intermediary services for major projects in order to attract investment. Lvliang will improve and perfect the evaluation system for attracting investment, and incorporate the relevant work into the annual target and responsibility assessment scope of all counties (cities and districts). Meanwhile, Lvliang will severely punish the inaction, slow actions, false acts and indiscriminate acts while advancing contracted projects as well as other factors that affect the implementation and commencement of projects. It will also increase the assessment weights for the introduction of major projects and the proportion of strategic emerging industries. 30. To solve the stubborn problems and pain points in handling affairs by the people: It is necessary to sort out the most troublesome and difficult areas and procedures from enterprises and the people, focus on addressing the matters that need repeated errands and long queuing time at windows, and notify a batch of typical cases. In the light of the problems identified in the investigation and secret inspection, and special survey of the improvement of the service level of hundreds of office halls in ten provinces, Lvliang will encourage authorities at all levels to speed up rectification and continuously improve the service quality and efficiency at windows. 31. To conduct assessment of the business environment: It is necessary to establish and improve a long-term mechanism for evaluating the business environment characterized by “the least review and approval procedure, the optimal workflow, the most unimpeded system, the most flexible mechanism, the highest efficiency and the best service”, carry out business environment assessment on counties (cities and districts) by relying on third-party institutions, and issue regular reports on the business environment of Lvliang. (V) Power services

32. To improve the work of reporting and installation of electric power: It is necessary to fully promote "zero door-to-door", "zero approval" and "zero investment" power supply services; further improve the capacity expansion standard, streamline the process of electric power reporting and installation, simplify data checking, improve the process, reduce handling time; upgrade the capacity of low voltage customer access to 100 KVA in rural areas and 160 KVA in urban areas. As for low voltage residents without and with external line access, it will not take more than two and four working days for installation; as for low voltage non-residents without external line access, it will not take more than three working days for installation; as for non-residents with external line access and without the need for road excavation, it will not take more than eight working days for installation (as for those with the need for road excavation, it will not take more than fifteen working days); as for high voltage users, it will not take more than fifty-five working days for installation. 33. To improve the reliability of power supply: It is necessary to reasonably plan the construction of power network, design the power supply access lines based on science, make off-peak arrangements for the operation and maintenance of power supply circuits, and fully guarantee the power supply for enterprise production. 34. To continue to promote direct power trading: It is necessary to actively strive for further expansion of the scale and scope of direct power trading. As for high capacity industries with large power consumption costs and in accord with the requirements of national industrial policies, Lvliang will allow all power to participate in direct power trading, and allow the corresponding generating units to reach the designed utilization hours. Lvliang will continue to practice its incremental power distribution network scheme, and reduce the power cost of enterprises as much as possible. (VI) Public services

35. To standardize government pricing procedures for water, power, gas and heat: It is necessary to encourage and support third parties to put forward pricing and price adjustment proposals and participate in public price hearing. Lvliang will improve the system of public and enterprise participation, legitimacy review and expert argumentation of government pricing, ensure that the working procedures are clear, standard, open and transparent, and make timely publicity on the official website of government pricing authorities to accept social supervision and effectively restrain government pricing. 36. To improve service efficiency: It is necessary to improve the service handling, streamline the reporting and installation, reduce the construction time, improve the service efficiency, and effectively address complicated procedures and low efficiency. Lvliang will greatly reduce the time for handling access to water, gas and heating, cancel the charges for application and handling as soon as possible, and see to it that the reporting and installation of municipal public infrastructure such as water supply, gas, heat, drainage and communication be handled upon gaining approval of the construction project planning license, and directly connected after the completion acceptance. Lvliang will promote large enterprises, research institutes, universities and related public service institutions to build independent incubators with legal person qualification; support production and manufacturing enterprises to build studios and forge studio brands through technology breakthroughs, solving production challenges, and refining innovation achievements; build up a number of demonstration bases or maker spaces for entrepreneurship and innovation, science and technology incubators, a base management service platform for "entrepreneurship and innovation"; promote mass entrepreneurship and innovation, encourage enterprises to actively establish enterprise technology centers at the national, provincial and municipal levels. In 2019, a dynamic mechanism combining real-time and regular adjustment for the market access negative list should be built, and a unified list code system established. Lvliang will launch self-inspection on the implementation of policies and measures for the unified market and fair competition; review and abolish the measures involving local protection, designated transactions, market barriers or contents that hinder the unified market and fair competition; remove local protection to ensure the fair treatments on subjects of different ownership in qualification licensing, government procurement, science and technology projects, and formulation of standards. To push forward to prevention and control of pollution: It is necessary to cement the achievements in the battle to protect the blue sky, clear water and pure land, thoroughly implement the eight major projects for ecological and environmental protection; improve the environmental supervising and monitoring network, step up the development of clean energy and new energy; address both symptoms and root causes of air pollution, improve the normal prevention and control mechanism, and maintain good air quality; promote water pollution control, establish river chief system, continuously improve water environment quality; launch soil pollution control and restoration projects to ensure the quality of agricultural products and safety of living environment; continue with the comprehensive management of coal mining subsidence area and ecological restoration demonstration projects of mines; advance the systems of natural ecology protection and restoration, ecological compensation, and ecological environment supervision, in order to gear up the damage compensation, protection and restoration of ecological system; explore the market-based and diversified ecological compensation mechanism and build an economic system featuring green and low-carbon cyclic development. To improve the transport infrastructure construction: It is necessary to develop the transport infrastructure network, enhance accessibility and convenience of comprehensive transport in order to build a comprehensive transport network. Lvliang will adjust the transport structure, develop a green transport system; improve allocation of public transport resources, advance integrated construction of urban and rural passenger transport, increase promotion and application of intelligence and information technology in the transport industry, and promote the system of "smart transport"; make structural adjustment of the transport structure, vigorously develop the general aviation industry and significantly increase the proportion of railway freight. II. Organization and Implementation

(I) To enhance leadership: It is necessary, for all counties (cities and districts) and municipal authorities, to improve the business environment, clearly define and practice the job responsibilities, and carry forward work in an orderly manner. Lvliang will effectively strengthen subject consciousness, and the responsible persons will practice the work while shouldering the responsibilities as the "first responsible persons".

(II) To improve the interactive mechanism: It is necessary for all authorities to realize the significance of improving the business environment, the main leaders should study and deploy arrangements personally, the responsible persons should take charge and implement; according to the division of functions of competent authorities at the county, municipal and district levels, specific work plans with the refined and decomposed target tasks and supporting policies and measures should be formulated, ensuring that all key tasks take effect. In particular, the grassroots level should be encouraged to forge new heights of reform through bold exploration as "pioneer cattle" or "vanguard".

(III) To strengthen supervision: It is necessary for all counties (cities and districts) and authorities to step up the supervision and inspection work, establish and improve the assessment and evaluation mechanism, ensure implementation of the authorities, responsibilities, programs and measures. Lvliang will incorporate the key task of improving the business environment into the 13710 supervision system of Lvliang Municipal People’s Government in order to strengthen supervision and management in the whole process. As for those organizations and persons which have achieved positive results in improving the business environment, circulate commendations will be given; as for those organizations and persons left behind for ill-performance or slow progress, accountability will apply.

(IV) To reinforce guidance of public opinions: It is necessary to publicize Lvliang’s reform policies to improve the business environment, advanced models and performance through opening up publicity columns, holding expert interviews or other forms or from other angles. Lvliang will answer and respond to the focused and difficult issues of social concern, enable enterprises and the people to fully understand the policies, and create a favorable atmosphere where the whole society pays attention to, supports and participates in the improvement of the business environment.
